Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of the Cakesify platform ("Platform"), operated by Cakesify Systems Private Limited ("Cakesify", "we", "our", "us"), CIN U62099KL2026PTC099825, with its registered office at C/O Ouseph M.M, Maravattickal House, Meenangadi, Wayanad, Sulthan Bathery, Kerala, India – 673591.
These Terms are published in accordance with the Information Technology Act, 2000 and the rules thereunder, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection (E-Commerce) Rules, 2020, and the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. This is an electronic record generated by a computer system and does not require a physical or digital signature.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which forms part of these Terms. If you do not agree, please do not use the Platform.
These Terms apply to all users of the Platform, including:
- Buyers purchasing food products from a Seller Storefront.
- Sellers (independent food businesses, including home-based sellers, bakers, tiffin and cloud kitchen operators, caterers, and other licensed or registered food operators) listing and selling products through the Platform.
- Any other users accessing or browsing the Platform.
By using the Platform, you confirm that you are competent to enter into a legally binding agreement under applicable Indian laws. Sellers are additionally governed by the Seller Platform Agreement, which takes precedence over these Terms in the event of any conflict in respect of Seller matters.
Cakesify is a technology service provider and software-as-a-service platform that enables independent food businesses to create and operate their own online storefronts. Cakesify provides storefront infrastructure, order management tools, payment gateway integrations, AI-assisted listing tools, and related technology services.
Cakesify is not the seller, manufacturer, food preparer, packer, delivery provider, merchant of record, agent, or owner of any products listed or sold by Sellers, unless expressly agreed in a separate written agreement. Cakesify does not sell products directly and does not provide delivery services.
The Seller is the Food Business Operator, merchant of record, product owner, price setter, and fulfiller for all products listed on their Seller Storefront. The contract for the sale of any product is formed solely between the Seller and the Buyer. Cakesify does not take title to any product, does not independently verify the quality or safety of food products, and does not guarantee delivery or fulfilment.
Notwithstanding the above, where Applicable Laws impose obligations on Cakesify as a technology platform, e-commerce entity, payment facilitator, Data Fiduciary, intermediary, or food e-commerce platform (including the Consumer Protection (E-Commerce) Rules, 2020 and applicable FSSAI directions), Cakesify may take such actions as are necessary to comply with law, including suspension, delisting, refund assistance, grievance handling, regulatory reporting, or requesting compliance documents from Sellers.
- You must be at least 18 years of age and competent to form binding contracts. The Platform is not intended for use by individuals under 18 years of age, who may use it only under the supervision of a parent or legal guardian.
- Registration is recommended for order tracking and is required for Seller operations. Buyers provide details such as name, email, phone, and delivery address. Sellers provide name, email, phone, address, GST number where applicable, FSSAI registration or licence, and other licences required by law.
- You must provide accurate, current, and complete information and keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and must notify Cakesify promptly of any unauthorised access.
- Payments are processed through third-party payment gateways such as Razorpay (and Stripe or equivalent for international operations), including UPI, credit or debit cards, and wallets.
- Applicable payment gateway charges will apply as specified during checkout, and all payments are subject to the terms and policies of the payment gateway.
- Cakesify facilitates payment collection solely as a technology intermediary and is not the merchant of record unless expressly stated in a separate written agreement.
- Cakesify does not store full card or payment credentials. Payment data security is governed by the payment gateway provider.
You agree to:
- Provide accurate and up-to-date information and use the Platform lawfully.
- Maintain account confidentiality and notify Cakesify of any unauthorised access.
- Ensure that any content you post (including reviews, ratings, and comments) is truthful and lawful.
- Comply with all laws, regulations, and policies governing food safety, advertising, and e-commerce.
You must not use the Platform to impersonate others or provide false information; upload offensive, obscene, or unlawful content; hack, reverse-engineer, or disrupt the Platform; or violate the intellectual property rights of Cakesify or others.
Sellers using Cakesify are additionally bound by the Seller Platform Agreement. Sellers remain solely responsible for compliance with applicable laws, food safety, product quality, pricing, fulfilment, packaging, delivery, customer support, taxes, licences including FSSAI where applicable, and all obligations arising from the sale of their products. In the event of any inconsistency relating to Seller obligations, the Seller Platform Agreement shall prevail.
- Ensure that delivery address and contact details are accurate and complete.
- Raise order issues with the Seller in the first instance; Cakesify may assist as a facilitator and, where required by law, may handle or escalate grievances.
- Acknowledge that Cakesify is not responsible for defects, delays, or damages arising from a Seller's products, preparation, packaging, or delivery.
- Provide only necessary information when placing an order. Where an order includes limited child-related information, such as a name to be written on a cake, it will be used only to fulfil that order and not for profiling or targeted advertising.
All Intellectual Property in the Platform, including the name "Cakesify", the Cakesify logo, software, designs, and graphics, is owned by Cakesify or its licensors. You may not copy, reproduce, or use such content without prior written consent. Sellers retain ownership of the product images and content they upload, and grant Cakesify a non-exclusive, royalty-free licence to display and process such content for the purpose of operating and promoting the Platform and the Seller's Storefront.
All collection and processing of personal data are governed by our Privacy Policy, available at cakesify.com/privacy-policy, and are carried out in accordance with the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. Cakesify collects only the personal data necessary for order processing, account management, platform operations, and legal compliance. Buyer data is shared with Sellers only to the extent required for order fulfilment. Data is protected using reasonable technical, organisational, and administrative safeguards.
You are responsible for any content you upload or share, including reviews and ratings. Cakesify reserves the right to remove or block content that is misleading, offensive, unlawful, or in violation of these Terms. You agree to indemnify Cakesify against any losses arising from content you post.
You agree to indemnify and hold harmless Cakesify and its affiliates, directors, officers, and employees from any claims, damages, or losses arising from your violation of these Terms, product defects or misuse, any unlawful, negligent, or fraudulent activity, or any infringement of intellectual property rights.
To the maximum extent permitted by Applicable Law, Cakesify is a technology infrastructure provider and is not liable for indirect, incidental, special, or consequential damages, nor for internet outages or connectivity issues, incorrect data or incomplete transactions, product quality or delivery by Sellers, or disputes between Sellers and Buyers.
As between Cakesify and the Seller, responsibility for products, food safety, fulfilment, packaging, delivery, and regulatory compliance rests with the Seller, except to the extent that liability arises from Cakesify's own breach of these Terms, wilful misconduct, gross negligence, platform error, or obligations that cannot be excluded under Applicable Law.
Cakesify may suspend or terminate user access for any violation of these Terms or Applicable Law, or where required to comply with a legal or regulatory obligation. Users may close their accounts at any time by contacting Cakesify. Suspension or termination does not waive Cakesify's rights to pursue claims or indemnity, and provisions relating to indemnity, limitation of liability, and dispute resolution survive termination.
Cakesify is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, pandemics, or acts of God; war, terrorism, riots, or labour disputes; and internet outages, technical failures, or unauthorised intrusions.
In the event of a dispute, the parties shall first attempt to resolve the matter through good-faith negotiations, initiated by written notice to the other party.
If the dispute is not resolved within 30 days of written notice, either party may refer it to mediation conducted in Wayanad, Kerala, under the Mediation Act, 2023.
If mediation fails, the dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator mutually appointed by the parties, conducted in English with the seat of arbitration at Kochi, Kerala. For disputes involving international parties, the UNCITRAL Arbitration Rules shall apply with the seat at Kochi, India.
These Terms are governed by the laws of India, and the parties submit to the exclusive jurisdiction of the courts at Wayanad, Kerala. Nothing in this Section restricts a Buyer's right to file a complaint before the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
For any queries, complaints, or grievances in relation to the Platform or these Terms, you may contact us using the details below. Our Grievance Officer will acknowledge consumer complaints within 48 hours and endeavour to resolve them within one month, as applicable under the Consumer Protection (E-Commerce) Rules, 2020. Complaints relating to intermediary or user-generated content will be handled within the timelines prescribed under the Information Technology Rules, 2021.

- Entire Agreement: These Terms and the Privacy Policy constitute the complete agreement between you and Cakesify in respect of your use of the Platform. Sellers are additionally bound by the Seller Platform Agreement.
- Amendments: Cakesify may update these Terms by publishing a revised version on the Platform with an updated effective date. Continued use of the Platform after publication constitutes acceptance.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force and effect.
- Waiver: Failure to enforce any provision does not waive Cakesify's right to enforce it in the future.
- Language: These Terms are executed in English, which prevails over any translation.
We may update these Terms from time to time. Changes will be reflected on this page along with an updated effective date.
